Kings View Chambers recently represented a doctor who was subject to a 12-month suspension order imposed by the Medical Practitioner’s Tribunal for allegations of dishonesty relating to matters of fraud.
Kings View Chambers recently represented a doctor who was subject to a 12-month suspension order imposed by the Medical Practitioner’s Tribunal for allegations of dishonesty relating to matters of fraud.
At the substantive hearing the Tribunal noted that the decision between erasing the doctor from the medical register or imposing a suspension order was borderline and that the doctor had yet to develop full insight into the misconduct.
The doctor approached Kings View Chambers mid-way through the suspension period having read about a doctor who has been represented by us in similar circumstances and who had achieved a successful review hearing outcome.
We worked with the doctor and assisted in putting in place a strategy to ensure that the doctor would be able to persuade the review Tribunal that they had developed sufficient insight into the misconduct that led to the suspension and had sufficiently remediated to ensure that the risk of any repetition would be low.
The doctor felt confident going into the review hearing and we were successful in persuading the Tribunal not only that the doctor was fit to practise but that doctor could be returned to the register with immediate effect rather than at the end of her suspension period.
Doctor was delighted with the outcome and to be able to now assist colleagues in the current pandemic.
