This case is another Coroner’s case where the Trust insurers and solicitors found themselves in conflict between the Trust and the individual nurse. It is always better if you obtain independent legal advice early on so that you can protect yourself.
NMC fitness to practise defence barrister, Catherine Stock, said:
“Lessons learned from this case are to ensure you liaise and engage directly with the Coroner, having secured independent legal advice and secondly ensuring that when things do go wrong you are open and honest and learn from any remediation.”
Our client, CE, said:
“In 2019, I was referred to the NMC fitness to practice. I was quite in shock at the time, given my years of unblemished practice. I initially contacted my Trade Union for representation, but I felt it was wise to seek a second opinion for advice.
“I went online and checked rigorously and found Kingsview Chambers. I made contact and straight away I received a call back from Stephen McCaffrey. I explained the situation, and he had a clear understanding of the case.
“I did not doubt his expertise and professionalism. Subsequently, Catherine Stock came on board, and we took it from there. She explained step by step the strategy to adopt regarding the case. She maintained regular communication, provided guidance, support and advice. She worked relentlessly and was optimistic for a positive outcome to be achieved at the Case Examiners stage.
“I could not believe it when she informed me before Christmas that “no case to answer and case closed’.
“The news was the best Christmas present that arrived early. I cannot express my gratitude enough to Catherine Stock, Stephen McCaffrey and the entire Kings View Chambers for all they do. I will absolutely recommend Kings View Chambers anytime. Thank you so much once again, Catherine.”
