Client cleared of all fitness to practise allegations

Our client has been cleared of all probity and integrity allegations after an 18‑month investigation concluded with a full finding in his favour at the facts stage.

A healthcare professional has been cleared of all probity and integrity allegations after an 18‑month investigation concluded with a full finding in his favour at the facts stage.

Our client, AS, sought new representation after becoming dissatisfied with the approach taken by his indemnity provider, which had been partly responsible for certain allegations being pursued. Following an initial review, Kings View Chambers took over AS’s representation and defence strategy, ultimately successfully demonstrating that none of the allegations could be proved.

After 18 months of preparation and evidence analysis, the fitness to practise panel found that none of the allegations were proved, bringing the matter to an end at Stage 1.

Fitness to practise defence barrister, Stephen McCaffrey, commented:

“The case outcome reflected early strategic planning, consistent engagement and a clear working relationship between AS and his representatives.”

In a testimonial, AS said:

The client described their case as one of the most distressing experiences of their professional career, facing a serious allegation they did not commit. After receiving inadequate support from their indemnity provider and unaffordable advice from another firm, they turned to Kings View Chambers.

“They said working with Stephen McCaffrey was the first time they felt genuinely supported. Stephen quickly identified the weaknesses in the regulator’s approach, set a clear strategy, and guided the client through every stage of the fitness to practise process — from preparing documents, witness statements and character references to ensuring they were fully ready for their hearing.

“The client emphasised Stephen’s commitment, expertise and personal investment in achieving the right outcome, noting that the support continued even after the case concluded. They credit Kings View Chambers with taking them “from the darkest days” to feeling able to practise again, calling the service a “no‑brainer” for anyone facing a fitness to practise investigation.”
