Kings View Chambers achieves revocation of suspension order for a doctor who was subject convicted of fraud.
The case
Dr SS was suspended for 8 months last year by the Medical Practitioners Tribunal (MPT) for using a travel pass that did not belong to them on multiple times. Dr SS gave a dishonest account to the inspector and was subsequently convicted. Dr SS continued to deny offence before the MPT.
Dr SS instructed Kings View Chambers to assist with the review of their Suspension Order. Dr SS was represented by health and care defence barrister Catherine Stock, who persuaded the tribunal to find that Dr SS was no longer impaired and revoked the current Suspension Order with immediate effect.
The verdict
The tribunal considered Dr SS’ reflections to be thorough and genuine and that their CPD was well documented. It was satisfied that throughout Dr SS’ oral evidence, they had provided genuine and honest responses regarding their acceptance of her dishonest conduct.
Furthermore, the tribunal was impressed that, despite the challenges presented by the Covid- 19 pandemic, Dr SS had continued with online training, PDP and secured a mentor that Dr SS had continued to liaise with, which was all to her credit.
Catherine Stock said:
“We became involved with Dr SS after their suspension and advised and helped to guide Dr SS over the last 8 months in respect of how best to approach a review hearing and how to ensure that the steps taken actually demonstrate insight and remediation.
“This case highlights the importance of a tenacious approach by the barrister and client and the significance of working on insight and remediation right up to the hearing date.”
Dr SS said:
“Ms Stock has been absolutely fantastic throughout my experience. She is very knowledgeable and knows exactly what she is talking about. Her advice was honest and accurate from the start.
“She also has a very understanding and non-judgemental approach which is very supporting at tough times. I could not have asked for a better barrister. I am very grateful.”
