No case to answer for HCPC client

Kings View persuade Health and Care Professions Council there is no case to answer at investigation stage for client who self-referred.

In this case, our client, M, was required to self-refer to the Health and Care Professions Council (HCPC) when he was under investigation at work for matters relating to making inappropriate remarks.

Kings View worked with M from an early stage and our strategy was successful as the HCPC found no case to answer at investigation stage due to the way in which the registrant had dealt with issues raised.

Fitness to practise defence barrister and joint head of chambers, Catherine Stock, commenting on this case, said:

“It is so important to be able to balance a good working relationship with professionalism and that balance is often hard to achieve particularly in the NHS where close teamwork and camaraderie is central to the efficient and effective running of any department.

“We can help if you find yourself in a similar situation either at work or if referred to your regulator. Instructing us to help early, leads to a better outcome.”

M, commenting on his case and work with Kings View said:

“I would like to sincerely thank Catherine for her help in my case resulting in ‘no case to answer.’ She was very calm, clear, methodical in explaining the process, outcomes and likely interventions at a time of great stress where my processing capacity was low. I understood the process because of how she delivered the information to me. We had a telephone call and a conference call where she afforded me the opportunity to invite a colleague to be able to help remember the information. Her reply to the HCPC based on my answers to allegations was worded exceptionally well with the focus on the content the HCPC would recognise and promote the greatest credence to myself with a common sense answer-approach, Catherine made it clear to the panel my exact situation and how these events could be interpreted with a punitive view resulting in the no case to answer decision.

“I am so grateful to this genuine lady for her professionalism, expertise, manner in which she kept me calm, whilst not giving me false hope.

“I cannot recommend her enough – to anyone who needs help in what feels like an impossible situation. She has the knowledge that will carry you through. I thought that my case based on others incorrect interpretation of events, would definitely go further than it did and I feel that Catherine’s replies and advice saved me from this, and moreover from a great deal of stress at a time when I was not strong enough to deal with it. I for one know what these situations do to people who were otherwise happy with their lot in life and who don’t deserve the anxiety provoking situations these events cause. Never did I (and my ex-colleagues) ever think this would happen to me.

“Thank you, Catherine. I will be sure to recommend you to anyone who would need your assistance.”
